Revision of Swiss Liability Law

        
 
 

The Swiss Federal Government has been working on the revision and unification of Swiss Liability Law. The aim of the unification is to end with the differences of regulation in many aspects (i.e. extinctive prescription) that receive a number of various solutions from one special statute to the other.

The Draft prepared by a Commission of Experts proposes a General Part of the Liability Law to be included in the Swiss Code of Law of Obligations (Obligationenrecht). Special Statutes should be adapted to this General Part.

The Experts Project does not affect the main principles of the present Liability Law. Nevertheless, it makes some suggestions concerning aspects where legal scholarship and parliamentary intervention have demanded a legal reform.

On 9 October, the Draft Project was sent out for comments to the cantons, political parties, professionals and other interested circles.
